Privacy Policy

1. Introduction

TW Partners, LLC (“Provider” or “we” or “us”, as context requires) respects your privacy and this privacy policy (“Privacy Policy”) describes how we collect, use, share, and store your information. Provider is the owner and operator of the TW Software and Services (each as defined in the Terms of Service (“Terms of Service”), and collectively, the “Platform”). This Privacy Policy should be read in conjunction with the Terms of Service and is integrated into the Terms of Service as one agreement. All capitalized terms not defined in this Privacy Policy will have the same definitions and meanings as defined in the Terms of Service. Please review this Privacy Policy periodically as we may revise it from time to time. If you do not agree with or accept our Privacy Policy in its entirety, you must not access or use the Platform. If you use the Platform following a change to the terms of this Privacy Policy, you agree to accept the revised policies unless we notify you that affirmative acceptance is required for material changes.

2. Applicability of Privacy Policy

This Privacy Policy applies to information we collect:

  • On this Platform; or
  • Through your (i) submission of any Customer Data, (ii) use of our services offered on the Platform, or (iii) communications between you and us.

3. Information We Collect About You and How We Collect It

We collect several types of information (collectively “Personal Information”) from and about users of our Platform.

Collected Information

  • Identifying Information. Information that you submit directly to us such as: name, email address, password, login and account information, purchase and licensing information, personal information contained in any Customer Data, and other identifying information.
  • Payment Information. Personal Information regarding your use of the Platform including any services purchased: email, name, telephone, payment address, payment information, and billing information. Such information may be shared with our third party payment processors or resellers.
  • Customer Data. Some Personal Information may be collected from Customer Data uploaded or submitted to the Platform. Personal Information contained may include personal details, name, metadata or other Personal Information contained within any Customer Data.

Automatically Collected Information

  • Usage Information. Information that is automatically collected through third parties or through your Platform usage may include IP address, device ID, local browser storage information, connection information, operating system information, time zone and your Platform usage details.
  • Location Data. We may collect location data such as information regarding your location that may be provided through an electronic device being used to access the Platform. You may be able to opt out of certain location collection information by altering your settings.

Third Party Integrations, Links and Features.

  • Third Party Software. You may provide log-in information to Third Party Software to us and we may collect any information you make available through such log-in account. You must abide by all agreements with third parties when you provide such log-in information with respect to Third Party Software providers.
  • Links and Features.The Platform may feature links that link to third party-controlled products or services. The privacy practices of relevant third parties, including details on the information they may collect about you, are subject to the privacy statements of those parties, which we suggest you review. To the extent any linked online service is not owned or controlled by us, we are not responsible for these third parties’ information practices.

Automatically collected information helps maintain the Platform’s functionality, security, and performance, enabling us to troubleshoot issues and improve user experience. The information we collect may include Personal Information, or we may maintain it or associate it with Personal Information we collect in other ways or receive from third parties. It helps us to improve our Platform and provide specific services to you.

4. Cookies and Other Tracking

We use cookies to understand your use of the Platform, to remember you and your preferences, to track Platform performance, and to remember your logins. Further, we may use tracking to help us secure our Platform and to provide us session information. You may be able to opt out of cookies through your browser preferences. However, please be aware that rejecting cookies may alter or impair the functionality of our Platform.

5. How We Use Personal Information

We process your Personal Information for several purposes based on your interactions with our Platform, including:

  • Platform Management: We use your information to authenticate and remember you and to provide Services requested via the Platform.
  • Third Parties: We share your information with our third party partners in order to provide our Services.
  • Platform Enablement: Your Personal Information enables us to deliver the services you request and to make available all features of the Platform. Some of your information may be visible or shared with third parties based on the specific reasons for your submission of such Personal Information.
  • Customer Support: We process your Personal Information to respond to inquiries, resolve issues, and offer support as needed.
  • Administrative Communications: We may use your data to send important updates about our products, Platform changes, or policy updates.
  • Feedback Requests: We may reach out for feedback about your experience to improve the Platform.
  • Marketing and Promotions: We process your Personal Information you provide to send you marketing materials, according to your preferences. You can opt-out at any time.
  • Platform Effectiveness: We process data to assess and improve the effectiveness of our Platform and to understand how you use our Platform.
  • Legal Compliance: We may process your information to comply with legal requirements, respond to disputes or court orders, and protect our legal rights or business interests.

We will only keep your Personal Information for as long as it is necessary for the purposes set out in this Privacy Policy, unless a longer retention period is required or permitted by law (such as tax, accounting, or other legal, business, or investigatory requirements).

6. How We Share Personal Information

We may disclose aggregated information about our users, and information that does not identify any individual, without restriction.

We may disclose Personal Information we obtain about you (as described above) to:

  • Subsidiaries and affiliates;
  • Contractors, service providers, and other third parties we use to support our business, including but not limited to payment and purchase processors, data security, content management and messaging, email and communications providers, analytics, marketing, and performance monitoring providers, website hosts, customer support vendors, infrastructure providers, and/or diagnostic tools;
  • A buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which Personal Information held by us is among the assets transferred; and
  • Third parties and other users with whom you have instructed us to share your information.

Further, we reserve the right to use your Personal Information, where necessary, as follows:

  • To comply with any court order, law, investigation, threatened litigation or dispute, or legal process, including to respond to any government or regulatory request;
  • To share your information with our business partners to offer you certain products, information, or promotions;
  • To enforce or apply our Terms of Service or other agreements; and
  • If we believe disclosure is necessary or appropriate to protect the rights, property or safety of our company, our partners, our customers, or others. This includes exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction.

7. Choices About Your Information

We strive to provide you with choices regarding the Personal Information you provide to us. We have created mechanisms to provide you with the following control over your information:

Tracking Technologies. You can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. If you disable or refuse cookies, please note that some parts of this Platform may then be inaccessible or not function properly.

Updating or Deleting Information. If you have any questions or wish to review, change, delete, or access any of your Personal Information collected by us, please contact us at support@twpartners-llc.com. The rights set forth in this section are subject to applicable law and we may reject requests that are unreasonable or not required by law, including those that would be prohibited by law, could require disproportionate technical effort, or subject us to additional legal or business liability.

8. California Users

California’s “Shine the Light” law (Civil Code Section § 1798.83) permits users of our Platform that are California residents to request certain information regarding our disclosure of Personal Information to third parties, at no cost, once per year. California users under the age of 18 have additional rights to request the removal of unwanted publicly available Personal Information. California residents may additionally have rights under the California Consumer Privacy Act, as amended by the California Privacy Rights Act, including the right to know, delete, and opt out of the sale or sharing of Personal Information. 9. Do Not Track

Some Internet browsers may be configured to send “Do Not Track” signals to the online services that you visit. We currently do not respond to “Do Not Track” as no industry standard has been adopted regarding “Do Not Track”. To find out more about “Do Not Track,” please visit http://www.allaboutdnt.com. The Platform does support the Global Privacy Control (GPC), a browser signal or extension that facilitates the process for users to indicate their privacy preferences while navigating the internet. You may download a GPC compatible browser and follow the instructions by such browser provider to set your privacy preferences.

10. Data Security

We use industry standard measures designed to secure your Personal Information from accidental loss and from unauthorized access, use, alteration, and disclosure. Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your Personal Information, we cannot guarantee the security of your Personal Information transmitted to our Platform. Any transmission of Personal Information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Platform. If we become aware of a breach that affects the security of your Personal Information, we will provide you with notice where required by applicable law. Where permitted by applicable law, we will provide this notice to you through the email address associated with your TW account.

11. Children Under the Age of 18

Our Platform is not intended for users under the age of 18 years. No one under age 18 may provide any information to or on the Platform. We do not knowingly collect Personal Information from children under 18. If you are under 18, do not use or provide any information on this Platform or through any of its features, or provide any information about yourself to us, including any Personal Information. If we learn we have collected or received Personal Information from a child under 18 without verification of parental consent, we will delete that information. 12. Changes to Our Privacy Policy

From time to time, we may make changes to our Privacy Policy. If we make material changes to how we treat our users’ Personal Information, we will attempt to notify you using the email address we have associated with your account; it is your responsibility to ensure your email address is up-to-date. Your continued use of the Platform after such notification constitutes your acceptance of the updated Privacy Policy. The date the privacy policy was last revised is identified at the top of the page. Please periodically visit our Platform and this Privacy Policy to check for any changes.

13. Non-US Users

Your information may be transferred to and maintained on computers located outside of your state, province, country, or other governmental jurisdiction where the privacy laws may not be as protective as those in your jurisdiction. Your consent to this Privacy Policy followed by your submission of such information represents your agreement to that transfer. Information shall be collected, processed, stored, disclosed and disposed of in accordance with any applicable laws of the United States of America (“US”). If you are not from the US, you acknowledge and agree that we may collect and use your Personal Information and disclose it to other entities outside your resident jurisdiction. In addition, such information may be stored on servers located outside your resident jurisdiction US law may not provide the degree of protection for information that is available in other countries.
